The Blue Skys is a Global Skill Job Portal Services, provided by Goldwin Engineering and Construction Pte Ltd., for the purpose of administrative support in registering potential job seekers who wish to obtain employability and assist in posting their resume for hiring globally. Hiring Companies may use our services by subscribing for the search of potential skilled employees globally. You understand and agree that our Online Services are provided “AS-IS” and that Blue Skys assumes no responsibility for among other things, any service outages or interruptions.

In consideration for providing, you with access to our Online Services, you agree to provide true, accurate, current and You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, use of our Online Services, access to our Online Services or any of the content accessible through our Online Services.complete information about the job seekers as prompted by our Online Services ' registration process and update that information to keep it accurate.

You acknowledge and agree that our Online Services contain proprietary information that is protected by applicable intellectual property and other laws.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit for any commercial purposes, use of our Online Services, access to our Online Services or any of the content accessible through our Online Services.

You also agree not to use our Online Services to:
(a) violate or solicit the violation of any applicable local, state, national or international law
(b) infringe the rights of any third party, including but not limited to intellectual property rights and privacy or publicity rights; and,
(c) interfere with or disrupt our Online Services.

Furthermore, you agree that you will not use any automated device or process, such as a "bot" or a "spider" to copy or extract information or content from our Online Services, except to use such information or content for purposes of listing our Online Services with a search engine or other service designed to direct users to our website.

You further agree that you will not copy, modify, or publicly display any information or content on the site for use in any commercial manner, except to use such information or content for purposes of listing our website in a search engine or other service directing users to our website.

If you do not fulfill your obligations under this Agreement, at Blue Skys sole discretion and without limiting its other remedies, Blue Skys may terminate your access to part or all of our Online Services. However, our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

Your privacy is important to Blue Skys. By agreeing to this User Agreement, you also consent to the privacy practices to the extent you are covered by laws requiring your consent for data transfer to our Server, you agree that your data may be transferred to our Server and collected and used accordance with our policy.

Our Online Services may contain links to websites which are not operated or controlled by Blue Skys, whether for marketing purpose or otherwise. These links are provided to you as a matter of convenience. As Blue Skys does not control such sites and resources, you acknowledge and agree that Blue Skys is not responsible for their availability and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources.

You further acknowledge and agree that Blue Skys shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource.

You understand and agree that we, and our franchise associates, provide our online services "as is" and without any warranty or condition, express, implied, or statutory. We and our associates specifically disclaim any implied warranties of title or merchantability for a particular purpose and non-infringement.
You agree that use of the site and its content is at your sole and exclusive risk. Some jurisdictions do not allow the disclaimer of implied warranties, so the foregoing may not apply to you.

You expressly understand and agree that Blue Skys shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Blue Skys has been advised of the possibility of such damages), resulting from:
(i) the use or the inability to use the online services;
(ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the online services;
(iii) unauthorized access to or alteration of your transmissions or data; or
(iv) any other matter relating to the online services. Our liability, and the liability of our suppliers, to you or any third parties in any circumstance is limited to the greater of (a) the amount of fees you pay to us in the 12 months prior to the action giving rise to liability, if any. Some countries or states other jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you.

You agree to indemnify and hold Blue Skys and (as applicable) our parent, subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party.

You agree that Blue Skys may amend this Agreement at any time by posting the amended terms on our site at http://www.blueskys.biz. All amendments shall automatically be effective ten (10) days after they are initially posted on our site.
Your use of the Online Services following the effective date of any modifications shall constitute your binding acceptance of those modifications. Furthermore, you agree that this Agreement and all incorporated agreements may be automatically assigned by Blue Skys, in our sole discretion, to a third party in the event of a merger or acquisition.
This Agreement may not be otherwise amended except in a writing signed by an officer of Goldwin Engineering and Construction Pte Ltd.
You further understand and agree that Blue Skys, at its complete discretion, may remove or alter the Online Services or any of content available through them at any time and for any reason.

This Agreement and your relationship with Blue Skys shall be governed by the laws of Singapore as such laws are applied to agreements entered and to be performed entirely within Singapore, without regard to Singapore’s conflict of law provisions. Regardless of any statute or law to the contrary, you agree that any claim or cause of action arising out of or related to use of the Online Services or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Headings in this Agreement are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. This Agreement sets forth the entire and exclusive understanding and agreement between you and Blue Skys with respect to the subject matter hereof.
This Agreement supersedes and cancels all previous and contemporaneous agreements, commitments, and writings with respect to this subject matter. You agree that if any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

1. Agree to ensure that all documents submitted are genuine, true and correct. Any false declaration will be the sole accountability of the job seeker.

2. Agree to observe all Laws & Rules of Hiring Country.

3. Agree to pay a Non-Refundable registration fee of Thirty (30) US Dollars in the application process. Acknowledgement receipt will be provided as proof of successful submission.

4. Agree that the final approving authority for all work passes shall generally be the Manpower or Labour Ministry of the Hiring country.

5. Agree to pay Blue Skys a placement fee of only one (1) month salary upon approval of work pass by the relevant country authorities.

6. Agree that Blue Skys will not be held responsible either directly or indirectly after signing the Employment Contract with the hiring company with its terms and conditions of employment.

7. Agree that Blue Skys shall not be responsible for any wrongdoing by job seeker (applicant) inclusive of breaching company’s rules & regulations and the laws of the hiring country that leads to the termination of employment and or cancellation of the work pass. The job seeker further agrees that the one-month placement fee paid will not be refunded in such case.

Hiring Company may register in our global skill portal services by obtaining a special ID for the search of potential skilled employee.

1. Agree to pay a Non-Refundable yearly subscription fee of Three Hundred Sixty Five (365) US Dollars in the search registration process. Acknowledgement receipt will be provided as proof of successful registration.

2. The Resume Search package is an unlimited search of any category for 12 months period

3. Payment to be made prior to activation of account.

4. Blue Skys reserves the right to withhold delivery of services until all outstanding invoices have been fully settled.

5. Blue Skys will arrange the short-listed candidates for interview with the employer via our online portal or any other suitable online service.

6. Hiring company may out-source all documentations for work pass application for the selected candidate(s) to Blue Skys and will invoice the employer for its services inclusive of all government fees upon completion of work pass application.

7. Blue Skys will not be held responsible either directly or indirectly after signing the company’s employment contract with the employee.

8. The employer will not hold Blue Skys responsible for any false declaration by the selected candidate.

9. All prices quoted above are zero rated for Goods & Services Tax (GST) purpose.

The Blue Skys has developed a skills portal to facilitate personnel from anywhere in the world, to be able to “POST” their resumes with the objective of securing employment either locally or overseas.
Hiring Companies globally will be able to view the resumes in the portal, as posted by applicants in accordance to their category of job and select them for a potential job vacancy.

1. Subject to the terms, conditions and limitations of this Agreement, the Blue Skys may appoint Master Franchisee (MF) on commission basis to act on behalf of the Blue Skys for the purpose of providing administrative support in Registering of the job seeker who wish to obtain a personal global ID Number and assist in posting their resume.

2. The country MF will assist in the interview process of the short-listed candidates from the respective countries.

3. Authorization to use the MF’s current business name and be able to use the Blue Skys marks and System within the region allocated.

4. Authorization to display the Blue Skys Logo and name for the sole purpose of marketing the business on behalf of Blue Skys.

5. MF may appoint Field Managers on commission basis or on salary terms, to assist the MF in registration of jobseekers in remote states within the appointed territories.

6. All payment of registration fees will be via the secured payment gateways trough the portal. The MF will not collect any additional fee from the applicants, which will lead to a breach of this agreement.

7. If the candidate’s resume posted by the MF center through his MF Global ID Number is selected by a prospective employer, approved and issued with the respective work pass by the Manpower or Labour Ministry of the employing country, the MF will receive 40% of the placement fee (1month salary of the Employee) as an incentive for the follow-up of the candidate till arrival into the employing country.

8. Registration fee and other commission will be paid to the MF via the portal every fortnightly. MF will distribute the agreed commission to his field managers.

9. Breach Of Agreement - If there is any breach of this agreement identified, the Blue Skys will inform the MF by email to verify. If there is no reply to the email within 14 days from the date of the email letter, the Performance Guarantee Fee may be forfeited, and the agreement terminated immediately. All applicants who have registered in the Company’s portal through the MF will be notified accordingly. If the MF provides a satisfactory explanation on any breach of contract brought upon them, and proven to be justifiable, all persons involved in such a situation will be informed accordingly and no further action will be taken.

10. Premature Termination of Agreement - In the event of premature termination of the agreement by the MF, within the validity period, the Blue Skys will carry out a screening of all applicants registered by the MF for any claims or collection of fees that are not in accordance to the agreement. After the clearance by the investigation team of the Blue Skys, 70% of the Performance Guarantee will be refunded to the MF within 90 days upon receiving the letter of request from the intention of premature termination of the agreement.

11. In case, MF decides to not to renew the agreement upon maturity, 100% of the performance guarantee shall be refunded less administrative fee in accordance with the terms and condition of the agreement.

1. The Advertisement(s) is a self-posting DIY package as listed. No Refund on unused Job Posting package. Job Posting will be valid for 90 days.

2. You must ensure that all advertisements posted to the Site comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct of the country.

3. Advertiser shall be referred as the registered company contracting for the advertisement on Blue Skys.

4. Providing Advertiser with other recruitment services such as job postings, Banner advertising and other support services in accordance with the terms and conditions.

5. At all times, it is the responsibility of the Advertiser to ensure that all advertisements posted to the Site comply with all applicable legislation, regulations, by-laws, ordinances and codes of conduct of the country.

6. Shall not use the Blue Skys website to redirect user traffic to the Advertiser’s own website or any other third-party website.

7. Not to infringe on the intellectual property rights of any person or company including Blue Skys or download and copy information obtained through the use of our website.

8. Not allow or include any third party in the advertisement other than the Advertiser

9. Agree to defend, indemnify, and hold harmless Blue Skys from any claims, actions or demand, alleging or resulting from your advertisement or your breach of the terms and conditions.

10. All fees for advertisement must be prepaid and within the specified payment terms of Blue Skys.

11. Prices for services or Ad packages may vary at any time without prior notice. Advertisers shall not be entitled for any rebate or discount on previously agreed contracts as a result of changes to the pricing.

12. All prices quoted are exclusive of any applicable taxes unless specifically noted otherwise.

13. Blue Skys makes no representations and warranties of any kind, whether expressed or implied, for the services and in relation to the accuracy or quality of any information transmitted or obtained through the website. Blue Skys disclaims any representations or warranty, whether express or implied, as to the title, fitness for a particular purpose, merchantability, accuracy or standard of quality of the service or website and no warranty whatsoever is given that the service will be uninterrupted or error free.

14. The Advertiser shall indemnify and hold Blue Skys harmless at all times against all actions, proceedings, cost, claims, expenses, demands, liabilities, losses and damages whatsoever including without limitation for defamation, infringement of intellectual property rights, death, bodily injury, property damage or pecuniary losses howsoever arising which Blue Skys may sustain, incur, suffer or pay arising out of or in connection with the use of the website by the Advertiser.

15. A compulsory Ad Preview feature is provided for all Blue Skys online advertisements before payments are made, as such, request for refunds will not be entertained.

16. Advertisers may contact Blue Skys account managers before making a purchase on the advertising package or for all other services. All Advertisers are fully advised to make their own decision before they purchase any of the services. Refunds will be considered at the sole discretion of Blue Skys, should an advertiser decide later to withdraw their purchase before job posting goes live.

17. Discrimination against race and religion is not allowed in the posting of jobs.

18. Payment to be made prior to activation of Job Posting package.

19. Blue Skys will arrange the short-listed candidates for interview with the employer. If candidate is from a different country, an online interview can be arranged via our portal.

20. The employer will not hold Blue Skys responsible for any false declaration by the selected candidate.

21. Upon acknowledgement of this Agreement, no cancellation will be entertained subject to valid reason and reviewed by Blue Skys board.

22. You shall not disclose confidential information obtained using our website to any third party.
